EU: The right to disconnect: where are we?

EU Commission prepares second consultation on right to disconnect law. Legislation unlikely before 2029; employers urged to engage to shape future rules

The key points: The European Commission will soon launch a second consultation with social partners on a possible Directive for the right to disconnect. Earlier efforts to reach a voluntary agreement failed when employers withdrew support. Legislation is unlikely before 2029, given the lengthy consultation and legislative process.

Why this matters: A right to disconnect law could fundamentally change expectations around after-hours work and employee availability across the EU, affecting millions of workers and all employers with European operations.

What might happen next: The Commission will outline its vision for the law in the next consultation round. Draft legislation is expected in 2026, with final rules not in force until 2029 at the earliest. Employers’ input during consultations will be critical to shaping the final law.

What you should be doing: Engage with the consultation process if possible, either directly or through employer associations.
