Ireland: EWC law now on review group agenda

The Irish government’s newly established Employment Law Review Group will also examine Ireland’s EWC law, which is the subject of EU infringement proceedings over its deficiencies. 

Key points:  The Employment Law Review Group (ELRG) is now examining Ireland's European Works Council legislation. The EU Commission started infringement proceedings against Ireland over deficiencies in the law, but the Department of Enterprise refuses to acknowledge problems despite employer and employee side consensus

Why this matters: For multinational employers operating in Ireland, the current legal framework lacks proper dispute resolution mechanisms between EWCs and management. This creates uncertainty and potential legal exposure, as evidenced by the ongoing Verizon case now before the High Court.

What might happen next: Any new EU Directive could take years to implement, so the ELRG's recommendations could prompt legislative changes sooner. This is why we will be making a submission to the ELRG on EWC law and urge members to do likewise. Meanwhile the High Court case may result in a CJEU reference, potentially forcing Ireland's hand.
