$100,000 H-1B Fee Explained: Compliance, Strategy, and Next Steps
On September 19, 2025, President Trump issued a Presidential Proclamation, Restriction of Entry of Certain Nonimmigrant Workers, establishing new requirements for employers. Beginning September 21, companies must pay a $100,000 fee for each new H-1B petition filed for workers outside the United States unless they secure a national interest exception.
Industry and legal experts will provide CHROs and HR leaders with a practical overview of the proclamation and what it means for workforce planning, talent strategy, and compliance, as well as potential legal challenges.
Our speakers will:
- Break down the proclamation’s requirements, including the national interest exception.
- Explore potential legal challenges and areas where uncertainty remains, despite guidance from the White House and the Department of Homeland Security.
- Discuss forthcoming rulemakings from the Department of Labor on prevailing wage increases and the Department of Homeland Security on prioritizing higher-paid, higher-skilled applicants in the H-1B lottery.
- Answer member questions and help identify issues still outstanding.
