HR Policy Asks Biden Administration for ACA Reporting Relief

HR Policy joined several business groups in urging the Biden administration to delay the Affordable Care Act’s extensive employer reporting requirements during the pandemic and to reform them going forward.

The letter notes the ACA’s “compliance requirements have always been complex and administratively burdensome on employers.  With the current pandemic, the compliance complexities and tracking requirements are further exacerbated because employers are managing closures, decreased demand, work from home policies, furloughs, reduced hours, temporary layoffs and more.”

Specifically, the letter urges the new Administration to:

  • Provide employers with COVID-related relief under the ACA requirements in the very near term, and

  • Reform the information-reporting requirements to implement a consumer-friendly process for individuals, and a less burdensome and costly compliance process for employers.

Outlook:  While the IRS has provided relief for ACA reporting over the years, it is unclear how and when the IRS will respond to our latest request and comments of other business groups.
