Q4 2024 NLRB Report: More Changes as Biden Board Departs

HR Policy Association has released the 12th edition of its quarterly NLRB Report. The report provides a comprehensive update of law and policy developments at the National Labor Relations Board, including significant decisions, rulemakings, general counsel initiatives, and more.

The final quarter of 2024 saw the Board further restrain employer actions during union election campaigns, including making “captive audience” meetings illegal and restricting employer messaging on how unionization impacts the employer-employee relationship. 

  • Meanwhile, the Biden Board came crashing down following former Chair McFerran’s failed renomination bid, President Trump’s reelection, and his subsequent unprecedented termination of Democratic Board Member Gwynne Wilcox (currently being challenged in court). 

  • The Board has been left without a quorum, and accordingly, is largely unable to continue its policymaking functions for the time being.
