Employers in Philadelphia continue to wait for a ruling on the city's ban on salary history requests of employment applicants, as the procedural issue of whether the Philadelphia Chamber of Commerce has standing in the suit must still be resolved. Initially, the U.S. District Court ruled against the Chamber on standing but gave it two weeks to file an amended complaint, which it did on June 13th, identifying several member businesses that would be adversely affected. Mayor Jim Kenney has ordered a stay against enforcement of the ordinance until the court challenge is resolved. In addition to ruling on standing, the judge's decision on the preliminary injunction request will hinge on the Chamber showing a likelihood of success on the merits. If the court lifts the stay or denies the injunction, employers will need to be ready to quickly comply with the law.
