The Worker Adjustment and Retraining Notification Act (WARN) requires sixty days advance notice prior to plant closings and mass layoffs, as defined by WARN, involving a minimum of 50 employees at a single worksite. Legislation has been introduced in Congress to increase the length of the notice and expand the situations in which notice would be required.
The Association opposes any expansion of WARN that would expand the time or incidence of required notice, imposing new increased costs on employers in a precarious economic climate, further complicating compliance and increasing the likelihood of technical violations by well-intentioned employers.
